1. GENERAL FEATURES

1.1 Our goods are sold firm. No exchange or return of product is accepted, except by prior agreement.
1.2 In this case, the goods must reach us in PORT PAY, with a "RMA" return number identified on the outside of the box.
1.3 Our products sold with limited shelf life are no exception to this general rule.
1.4 Neither returns nor exchanges are accepted: personalized items or special orders if the order has been executed in accordance with the order received. Only UKAL products can be returned to us under certain conditions.
1.5 We reserve the right to apply a restocking fee for any defective or damaged equipment or product.

2. OWNERSHIP OF THE GOODS

Until the invoice has been paid in full, we reserve the right of ownership of the goods. The customer must insure himself against the risks of fire, burglary, theft and flooding from the date of shipment. Insurance receivables are assigned to us up to the amount due. In the event of seizure, garnishment or other measures taken by third parties, the customer must inform us immediately. In the event of total or partial non-payment of the price on the due date or in the event of non-compliance by the buyer with a single condition of sale, the seller may demand, as of right and without formality, the return of the goods at the buyer's expense, risk and peril. This refund is not equivalent to the termination of the sale.

3. PRICE

3.1 The prices indicated on our price list are given as an indication and are subject to variation, depending on the economic conditions of the day. During shipping it is the price of the tariff that will be applied.

4. REGISTRATION AND CANCELLATION OF ORDERS

4.1 Orders should be addressed to our customer service department:

Due to the speed of our deliveries, we do not confirm the orders received.

We reserve the right to cancel any order or contract in the following cases:

  • - Refusal to accept a draft,
  • - Return of unpaid bills of exchange,
  • - Bankruptcy or judicial liquidation,
  • - Change of company form,
  • - Insufficient credit coverage.

 

For all orders placed by phone, a written confirmation on signed letterhead may be required.

Backorder : unless otherwise specified, items that are not immediately available are kept pending and attached as soon as they are placed in stock, to the next order, at the rate in effect on the delivery date.

Order additions are treated as a new order, in accordance with our general terms and conditions of sale.

5. SHIPPING CONDITIONS

5.1 Minimums for free transport are subject to revision without notice, depending on the cost of petroleum products and transport.
5.2 Transport:
All our goods, even if shipped prepaid, travel at the risk of the recipient. We accept no responsibility for any damage or loss that may occur during transport. We only recognize the weight of our forwarding stations as valid, even if the goods are sold free of charge to the buyers' station. Three days after receipt, no claims will be accepted.
5.3 Receipt of goods:
All our packages are carefully controlled by our shipping services and have been delivered intact and in good condition. In the event of poor reception, trace of damage, torn tape or break-in, we disclaim all responsibility if no compliant reserve has been taken from the carrier at the time of delivery and confirmed to our customer service within 48 hours.

6. SHIPPING TIME

Our obligations, as regards the terms of delivery, are automatically suspended in the event of a partial or total strike, epidemic, fire, flood or deterioration, mobilization and in the event of force majeure. Shipping times are not strict. They are given as an indication and we do not accept any cancellation for late shipping, only after a formal notice by registered letter. We leave a margin of 15 days for shipping, this in case of force majeure.

7. WARRANTY

We decline any responsibility due to the user's failure to comply with the instructions for use of the products or devices sold. Only the defective design or manufacture duly certified by the manufacturer of the products or equipment could eventually lead to its being called into question.

8. DAMAGES AND INTEREST

Our liability is strictly limited to the obligations thus defined and express agreement that the seller shall not be liable to the buyer for any compensation for any damage suffered, such as - accidents to persons and animals, damage to property distinct from the object of the contract or loss of profit. We accept no liability for accidents that may occur during the use of our instruments, equipment and products.

9. TERMS OF PAYMENT

  • - Either at the end of the terms, by check or bank transfer.
  • - Either by credit card

Any costs corresponding to non-payment on the due date - unpaid draft - protest extension costs - litigation costs, etc., shall automatically be borne by the defaulting party.

By express agreement, and unless postponed, failure to pay for our supplies by the due date shall, regardless of the method of payment provided for, result in litigation, and the application as damages of an indemnity equal to 1% per month of the unpaid amount, in addition to legal fees and interest. The payment of a flat-rate indemnity for recovery costs is set at 40 euros. No discount is granted for early payment.

10. CLAIMS

For any complaints regarding shipping, please contact our customer service and attach the shipping note to the invoice.

11. PURCHASE TERMS AND CONDITIONS

Our terms and conditions of sale cancel the terms and conditions of our customers. The simple fact of placing an order with us implies that our customers waive the application of their purchase conditions.

12. RETURN OF GOODS

All returns require an "RMA" number. Contact customer service to get your number. The number must be written on the outside of the box and visible when the product is received. A return without a number will be refused.

Packaging and reshipment costs are the responsibility of the buyer who must ensure that his packaging will be strong enough to allow the products to be received in perfect condition at Ukal Canada's premises.

13. REFUNDS

The buyer has a period of 7 days from the delivery of the order to return any product that does not suit him.

The buyer may either exchange all or part of his order, or be refunded, provided that the returned products are in perfect condition as specified in the paragraph "Return of Goods". Ukal Canada will credit the customer at the customer's convenience on a future order.
